DMCA Policy for Miss Av

Miss Av, operated at missavlife.com, respects the intellectual property rights of others and expects our readers and contributors to do the same. This page explains how we handle claims of copyright infringement under the Digital Millennium Copyright Act, and how you can submit a notice or a counter notification.

01 Our Commitment to Copyright

Every article, photograph, and piece of original writing published on Miss Av is created by our team or by contributors who have confirmed the work is their own. We take copyright seriously, both in protecting our own content and in respecting the rights of other creators.

If you believe that content on Miss Av infringes a copyright you own or control, you may submit a notice under the Digital Millennium Copyright Act, 17 U.S.C. Section 512, using the process described below.

02 Filing a DMCA Takedown Notice

To file a notice of alleged copyright infringement, please send a written notice to our designated agent using the contact details at the bottom of this page. Upon receiving a complete and valid notice, we will review the claim and, where appropriate, remove or disable access to the material in question.

Please note: Under Section 512(f) of the DMCA, anyone who knowingly submits a false claim of infringement may be liable for damages. Please be certain of your rights before filing a notice.

03 What to Include in Your Notice

For your notice to be valid and actionable, it must include the following, in writing:

  • A physical or electronic signature of the copyright owner or a person authorised to act on their behalf
  • Identification of the copyrighted work you claim has been infringed
  • Identification of the material you claim is infringing, including the specific URL on missavlife.com
  • Your name, mailing address, telephone number, and email address
  • A statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf

04 Counter Notification

If you believe material you posted or that belongs to you was removed or disabled by mistake or misidentification, you may submit a counter notification to our designated agent. Your counter notification should include:

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district, or if outside the United States, a court where Miss Av may be found

Upon receipt of a valid counter notification, we may reinstate the material within the timeframe required by law, unless the original complainant files a court action seeking a restraining order.

05 Repeat Infringer Policy

Miss Av maintains a policy of terminating, in appropriate circumstances, the accounts or contributor access of individuals who are repeat infringers of copyright.

06 False Claims

Please do not submit a DMCA notice unless you are certain the material genuinely infringes your copyright. Misuse of the DMCA process can result in legal liability for the person submitting the false claim, and may delay our ability to help genuine rights holders.
